Preamble

These general conditions of sale (hereinafter “CGV”) apply to all sales concluded on the Babyparentalnews website, published by Babyparentalnews (hereinafter “the Seller”), whose head office is located in Vichy, and whose email address is kouentcs@gmail.com .

1. Object

The purpose of these General Terms and Conditions is to define the rights and obligations of the parties in the context of the online sale of children's clothing offered by the Seller to the customer (hereinafter "the Customer").

2. Acceptance of the General Conditions of Sale

By ordering on the Babyparentalnews website, the Customer accepts these General Terms and Conditions without reservation. The Seller reserves the right to modify the General Terms and Conditions at any time, the applicable conditions being those in force on the date of the order by the Customer.

3. Products

The essential characteristics of the products are described and presented with the greatest possible accuracy on the site. However, if errors or omissions were to occur in this presentation, the Seller cannot be held liable.

4. Price

The prices of the products are indicated in euros, all taxes included (TTC), excluding delivery costs. The Seller reserves the right to modify prices at any time, it being understood that the products will be invoiced on the basis of the prices in force at the time of validation of the order.

5. Order

The Customer places his order online on the Babyparentalnews website. Any order constitutes acceptance of the prices and descriptions of the products available for sale. The Seller will acknowledge receipt of the order by sending a confirmation email.

6. Payment

Payment is made online by credit card via a secure system. The Customer's bank details are not kept by the Seller. The order will be considered accepted after payment confirmation.

7. Delivery

The products are delivered to the delivery address indicated by the Customer when ordering. Delivery times are indicated for information purposes only and may vary depending on product availability. The Seller cannot be held responsible for delivery delays attributable to carriers.

8. Right of withdrawal

In accordance with article L. 221-18 of the Consumer Code, the Customer has a period of fourteen (14) days to exercise his right of withdrawal without having to justify reasons or pay penalties, upon request. exception of return costs. This period starts from receipt of the products by the Customer.

9. Return and Refund

In the event of withdrawal, the Customer must return the products in their original condition and complete (packaging, accessories, instructions, etc.) to the following address: [your return address]. The Seller undertakes to reimburse the Customer within fourteen (14) days of receipt of the returned products.

10. Guarantees

All products supplied by the Seller benefit from the legal guarantee of conformity provided for in articles L. 217-4 et seq. of the Consumer Code and the guarantee against hidden defects provided for in articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded.

11. Liability

The Seller cannot be held responsible for damage resulting from improper use of the purchased product. The Seller's liability will, in any event, be limited to the amount of the order.

12. Intellectual Property

All elements of the Babyparentalnews site are and remain the intellectual and exclusive property of the Seller. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound.

13. Personal Data

The Seller undertakes to preserve the confidentiality of the information provided by the Customer, which it may be required to transmit for the use of certain services. Any information concerning the Client is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Client has the right to access, modify and delete information concerning him.

14. Disputes

These General Terms and Conditions are subject to French law. In the event of a dispute, an amicable solution will be sought before any legal action. Failing this, the competent court will be that of the defendant's domicile or, at the plaintiff's choice, the place of actual delivery of the product.
